WOODY PARK – GENERAL CONDITIONS OF SALE AND SERVICES

SCOPE

These conditions of sale will prevail over all other general or specific conditions not expressly approved by WOODY PARK.

ARTICLE 1 – ORDERS

      ARTICLE 3 – LATE ARRIVAL

      The buyer must appear on the day and at the time mentioned on the order. In the event of a late arrival, the buyer cannot hold WOODY PARK responsible if all of the services cannot be performed. If the buyer does not show up on the day mentioned on the reservation without having notified WOODY PARK, the sums paid will remain with WOODY PARK. Therefore, no refund is due to the buyer.

      ARTICLE 4 – GROUP SERVICE

      For group services, WOODY PARK reserves the right to cancel or modify any group activity if the minimum number of participants is not reached, without compensation. A replacement activity could then possibly be proposed.

      Finally, on site, WOODY PARK reserves the right to modify or replace planned activities if circumstances make their practice impossible and / or dangerous. No compensation is paid in the event of a modification of the activity by WOODY PARK.

      ARTICLE 5 – PRICES AND TERMS OF PAYMENT

      The prices offered are prices including all taxes in euros taking into account the VAT applicable on the day of the order; any change in the rate may be reflected in the price of the products or services.

      WOODY PARK reserves the right to modify its prices at any time, it being understood, however, that the price offered on the day of the order will be the only one applicable to the buyer.

      All specific orders from the purchaser will be the subject of a quote previously accepted by the purchaser. An invoice will be established by WOODY PARK and given to the purchaser each time services or products are provided.

      The price is payable when ordering in its entirety for over-the-counter and internet purchases. The customer’s bank account will be debited for the amount of the order, upon final validation of the transaction.

      For orders by phone, a bank imprint of 30% of the total price will be requested. No direct debit will be made from the customer’s account, who will therefore have to pay for their entire service on the same day. The bank imprint is destroyed upon payment of the service. However, in the event of cancellation, Article 2 applies to this bank imprint

      ARTICLE 6 – INSURANCE

      ARTICLE 7 – STATE OF HEALTH AND BEHAVIOR OF THE PARTICIPANT

        ARTICLE 8 – COMPLIANCE WITH PARK REGULATIONS

        ARTICLE 9 – SPECIAL CONDITIONS RELATED TO THE ADVENTURE TRAIL ACTIVITY

        Access to the courses

        Access to the ground is authorized to all under the full responsibility of parents or accompanying adults, with one adult for up to 12 children. The OUISTITI course is reserved for children from 3 years old and up to 1.20 m. The PIVERT and ECUREUIL routes are authorized from 1.10 m. Access to the INDIANA course is authorized from 1.30 m. The VERTIGO and RAFIKI courses are accessible to people over 1.40 m. Young people under 16 must be accompanied by an adult at the rate of one adult for 3 children maximum except for the OUISTITI course. Activities should be performed by one person at a time.             ARTICLE 15 – LIABILITY OF THE SERVICE PROVIDER

            The service provider guarantees, in accordance with legal provisions, to the customer against any lack of conformity of the services and any hidden defect, resulting from a design or performance fault of the services provided and rendering them unfit for the use for which they are intended, to the exclusion of any negligence or fault on the part of the customer, for a period of 24 months from their supply to the customer.

            In order to assert his rights, the customer must, on pain of forfeiture of any related action, inform the service provider, in writing, of the existence of the defects within a maximum period of two months from their discovery.

            The service provider will rectify or have rectified, at its exclusive expense, the services deemed to be defective.
